Apple’s Paper Trail Contains a Hilarious Mix-Up

Apple alleges that it first reached out to OpenAI in February regarding concerns that former employees were in possession of confidential information but claims it received no response. However, the emails released by OpenAI reveal that Apple’s attorney, Gabriel Gross, had been in contact with OpenAI General Counsel Che Chang. Following a supposed phone conversation, Gross even expressed gratitude for the discussion. Chang, however, responded that this conversation had never taken place.

The situation escalated when Gross admitted that his follow-up email was mistakenly sent to Chang instead of another former Apple employee named Wang. This incident, according to OpenAI, illustrates a troubling confusion on Apple’s part, particularly in the way it conflates two Asian surnames.

Furthermore, OpenAI points out that Apple did not present the specific allegations that later surfaced in the lawsuit. Correspondence between the companies indicates that Apple was initially dealing with the issue before communication ceased for nearly five months, all while the tech giant filed its lawsuit on July 10.

OpenAI Brought More Than Emails

Apple’s lawsuit names former employees Chang Liu and Tang Yew Tan, asserting that they, along with OpenAI, unlawfully used Apple’s confidential hardware information to quicken OpenAI’s plans for consumer devices. Recently, Apple requested that OpenAI expedite the production of documents and schedule depositions with its corporate representatives.

OpenAI has also disclosed iMessages from Apple employees who continued to request Liu’s assistance in locating files and addressing technical inquiries after he had left the company. These exchanges contradict Apple’s claims that Liu intentionally retained access to sensitive information, suggesting that Apple’s failure to properly disconnect former employees from its systems contributed to the situation.

While these communications are part of OpenAI’s defense in an ongoing lawsuit and do not represent a court’s judgment, they reveal a conflict that Apple must address. The juxtaposition of employee requests for Liu’s assistance against claims that his continued access posed a significant risk complicates the narrative Apple has presented. The outcome of this legal battle could carry substantial implications for both companies and their future hardware ambitions.
