Zillow and Redfin Settle Major FTC Antitrust Case

Zillow and Redfin have reached a settlement with the Federal Trade Commission (FTC) and five states, ending a legal fight over a 2025 partnership that the FTC claimed hurt competition in the rental-listing market. The settlement was announced on Monday, just as the case was scheduled to head toward trial that morning.

Background of the Case

The legal dispute originated from a partnership announced last year, in which Redfin decided to display Zillow’s rental listings on its platforms instead of competing directly for rental advertisers. This arrangement had the potential to sideline Redfin from the rental advertising sector for up to nine years. Notably, Redfin operates Rent.com and ApartmentGuide.com, which are significant players in the rental-listing arena.

The FTC’s Allegations

The FTC, along with attorneys general from Arizona, Connecticut, New York, Virginia, and Washington, accused Zillow of striking a deal that discouraged competition by compensating one of its major rivals to prevent them from competing. As part of this arrangement, Zillow was reported to have paid Redfin a staggering $100 million.

While Zillow and Redfin defended the partnership as a beneficial arrangement that would provide renters access to a wider array of listings, the FTC argued that such deals could lead to higher charges for advertisers and poorer conditions for property managers. Additionally, it posed the risk of compromising the quality of rental listings available to consumers.

Details of the Settlement

As part of the settlement, Redfin will be mandated to re-enter the rental advertising market, lifting previous restrictions that limited its ability to compete directly for property-management clients. Although the relationship between the two companies persists, Redfin will regain its capacity to operate independently.

This entails that Redfin can not only display Zillow’s rental listings but also engage in selling advertisements and showcasing listings from its own clients. Crucially, Redfin will have the freedom to pursue new rental customers without being obligated to share sensitive business information with Zillow.

Context and Comparison to Other Antitrust Cases

The resolution of the Zillow-Redfin case follows close on the heels of another antitrust settlement involving Ticketmaster, handled by the Department of Justice (DOJ). In that instance, a significant number of state attorneys general opted to pursue the case further and achieved a legal victory this past April, highlighting the increasing scrutiny of dominant companies and their competitive practices.

The Zillow and Redfin settlement underscores the shifting landscape in the digital marketplace, with regulators recognizing the need to foster fair competition and protect consumer interests in the rapidly evolving world of online rentals.
