The Court’s Decision

On March 13, Nine PBS sent a formal request to Iron Mountain, the company housing its data, to address issues related to accessing their archival materials. Nine PBS expressed willingness to cover reasonable costs associated with retrieving the data. However, after failing to communicate effectively with OSS, Nine PBS secured a default judgment in the St. Louis Circuit Court. This ruling confirmed the station’s immediate right to possess the data, granting them the authority to either reclaim it or facilitate its transfer to a different vendor.

The Standoff with Iron Mountain

Despite the court ruling in favor of Nine PBS, Iron Mountain has thus far declined to release the data, citing contractual obligations with OSS and asserting that OSS owns the physical servers housing the information. A spokesperson for Iron Mountain clarified, “Our customers rent space for their servers and other hardware. These are the client’s assets. We don’t have access to the data on the hardware/servers because they belong to our customers.”

This raises an important issue regarding data privacy and contractual obligations, as the spokesperson also warned that granting unauthorized access could potentially breach their contract with OSS and compromise the confidentiality of data from other clients.

Concerns Over Data Loss

The controversy brings attention to the potential risk of losing essential archives. Nine PBS has not publicly stated whether they have additional backups of the data or what measures they will take to prevent such situations in the future. Leah Freeman, the VP and Chief Communications Officer at Nine PBS, released a statement expressing appreciation for the court’s decision and affirming the importance of these archives as part of the region’s history.

Freeman stated, “We appreciate the Court’s thoughtful decision establishing a path forward to access and recover our archival materials, which the Court confirmed that Nine PBS rightfully owns. These archives represent an important part of our region’s history, and we look forward to ensuring their preservation and protection through the Court-approved process.”

This case serves as a vital reminder for organizations about the significance of understanding their data storage agreements and the implications those agreements have on data ownership and access rights.
