HP India Fined for Collusive Practices in Printer Supplies
The Competition Commission of India (CCI) has imposed a significant fine on HP India, totaling 1.4 billion rupees (approximately $17 million), alongside penalties for 21 of its resellers amounting to 35.2 million rupees (about $365,335). This decision stems from findings that indicate a pattern of anti-competitive behavior within the printer supplies market.
Collusion and Bid Rigging Among Resellers
According to a CCI report, WhatsApp records unveiled a “collusive arrangement” involving HP and 16 of its Tier-2 reseller partners. The regulators identified activities such as bid rigging, price fixation, and customer allocation occurring between 2017 and 2020. The CCI indicated that HP India played a central role in these questionable practices.
Economic Pressures on Resellers
The CCI’s findings suggest that high prices for printing supplies compelled some resellers to threaten a shift toward low-cost counterfeit products as a means of competing on price. The order noted, “HP India was commercially forced into a position where it had to support the collusive arrangement adopted by the Tier-2 resellers.” Such pressures raise critical concerns about the underlying economics of the printer supply market.
HP’s Response to Allegations
In light of the recent developments, HP India expressed strong objections to being labeled as the “kingpin” of this collusive arrangement, seeking to clarify its position. Despite this, the findings reflect ongoing challenges faced by HP’s resellers, who are grappling with the high costs of printer ink and toner. This reality is further aggravated by HP’s approach to blocking third-party inks through firmware updates, which affects already-purchased printers.
