It looks a lot like what we’re observing on X, formerly Twitter. Users have been utilizing xAI’s Grok chatbot to create explicit content, including disturbing deepfake images of ordinary individuals. Reports indicate that Grok is generating an estimated one nonconsensual sexual image every single minute, with a notable focus on women and even children.

While it is impossible to directly request Grok for nude images, users have discovered workarounds. For instance, they can ask Grok to “undress” an image posted on X or place an individual in an invisible bikini. Despite existing laws against such abuses, xAI’s response has been notably apathetic. Journalists reaching out for clarity received automated replies, dismissing concerns as “Legacy media lies.” Elon Musk himself shared deepfake images of himself, demonstrating a disconnection from the public outcry surrounding these issues.

The Dilemma of Deepfake Technology

The situation on X serves as a grim reminder of the rapid advances in AI technology, complicating the landscape of consent and accountability. Historically, there have been instances of perpetrators using technology for sexual abuse, but AI takes it to a new level with the potential to create hyper-realistic deepfakes. The advent of nudify apps has made it disturbingly easy for users, including minors, to transform innocent images into explicit content without consent.

Legal Framework and Challenges

The passage of the Take It Down Act last year marked a significant step in criminalizing nonconsensual deepfake pornography, compelling platforms to remove flagged content. While it offers some hope, many victims find themselves vulnerable to prolonged exposure before enforcement measures can be implemented.

The Role of Tech Companies and Accountability

Sandi Johnson, Senior Legislative Policy Counsel at the Rape, Abuse and Incest National Network, highlights the concerning nature of how tech companies have designed their AI systems: “The prompts that are allowed or not allowed are the result of deliberate and intentional choices.” Holding tech companies accountable for their designs and the inevitable consequences of their products is imperative.

The Deepfake Epidemic on X

Observations indicate that the amount of sexualized deepfakes generated on X significantly surpasses that on other platforms. This unchecked growth can be attributed to the seamless integration of Grok’s capabilities within the ecosystem of X. As noted by various legal experts, the emotional and reputational harm resulting from these images can be exponentially more devastating given the platform’s extensive reach.

Are Platforms Like X Liable?

Social media companies benefit from Section 230 of the Communications Decency Act, which generally shields them from liability for the actions of their users. However, as companies like xAI generate explicit content through their chatbots, a legal gray area emerges regarding their accountability. Experts argue that while user prompts lead to the generation of content, the very existence of tools that facilitate such acts places the responsibility on the creators of those tools.

A Call for Accountability

As public outrage mounts over the deepfake crisis on X, there may be a shift toward greater accountability for tech companies. Countries around the world are beginning investigations into the proliferation of nonconsensual imagery on X, signaling that legislative changes may be on the horizon. Johnson sums it up succinctly: “This isn’t a computer doing this. These are deliberate decisions that are being made by people running these companies, and they need to be held accountable.”
