Purpose of the Legislation

SB 243 specifically targets companion chatbots—AI systems designed to mimic human interactions and address users’ social needs. The legislation restricts engagement in discussions surrounding sensitive topics such as suicidal ideation, self-harm, or sexually explicit content. To promote user awareness, platforms must send recurring alerts, particularly to minors, every three hours, reminding them that they are conversing with an AI, not a human being, and suggesting that they take breaks.

Additionally, the bill establishes annual reporting and transparency requirements for AI companies, including significant players like OpenAI, Character.AI, and Replika. These companies will be required to track and report their interactions involving potential crises, ensuring that they can refer users to appropriate support services when necessary.

Accountability and Legal Recourse

Under SB 243, individuals who believe they have been harmed due to violations of the law would have the right to file lawsuits against AI companies. This includes seeking injunctive relief and damages of up to $1,000 per violation, along with coverage for attorney’s fees.

A Response to Recent Tragedies

The urgency for this legislation gained momentum following the tragic suicide of teenager Adam Raine, who reportedly engaged in harmful conversations with OpenAI’s ChatGPT. Furthermore, leaked documents have raised concerns about Meta’s chatbots permitting “romantic” and “sensual” interactions with minors, thus amplifying the call for regulation.

Federal entities, including the Federal Trade Commission (FTC), have also begun scrutinizing the potential effects of AI chatbots on children’s mental health. Simultaneously, Texas Attorney General Ken Paxton has initiated investigations into Meta and Character.AI for allegedly misleading children regarding mental health issues.

Legislative Background and Future Prospects

SB 243, introduced in January by state senators Steve Padilla and Josh Becker, will be put to a vote in the state Senate on Friday. If passed, it will subsequently go to Governor Newsom for his endorsement. The proposed regulations would begin on January 1, 2026, with additional reporting requirements kicking in by July 1, 2027.

Senator Padilla emphasized the potential risks involved, stating, “The harm is potentially great, which means we have to move quickly.” His focus is on ensuring that users, especially minors, are not misled and have proper access to support resources in moments of distress.

Amendments and Adjustments

The bill initially included stricter measures, such as prohibiting chatbots from employing “variable reward” systems that may lead to addictive interactions. However, these provisions have been softened during various amendments. For instance, earlier requirements to track how often chatbots prompted discussions concerning self-harm were removed, aiming to strike a balance between regulatory rigor and operational feasibility.

Industry Pushback and Broader Implications

As SB 243 progresses, it arrives amid a wave of resistance from Silicon Valley firms that are investing significantly in political action committees advocating for a lenient approach to AI regulation. The bill is also set against the backdrop of another proposal, SB 53, which would impose more stringent transparency requirements. While OpenAI and other major tech companies have expressed disapproval of SB 53, Anthropic has shown its support.

Padilla argues against the notion that regulation stifles innovation, asserting, “We can support innovation and development that we think is healthy and has benefits… and at the same time, we can provide reasonable safeguards for the most vulnerable people.”
