T-Mobile has initiated a lawsuit against Broadcom in a New York court, seeking a ruling that would compel Broadcom to fulfill its contractual obligation to provide continued support for T-Mobile’s VMware perpetual licenses. The Scale of T-Mobile’s Virtualization Needs

In its complaint, T-Mobile highlights its reliance on VMware software, with tens of thousands of virtual machines deployed across approximately 303,140 CPU cores. This infrastructure is pivotal for the mobile carrier’s operations. However, the company is in the process of migrating off VMware, a transition that poses significant technical and logistical challenges, particularly as it involves over 1,000 applications.

Background of the Lawsuit

This lawsuit, filed in August 2025 in the Supreme Court of the State of New York, stems from T-Mobile’s acquisition of VMware perpetual licenses in 2023. At that time, they also purchased two years of support with an option to extend for a third year. However, after Broadcom’s acquisition of VMware, the company ceased the sale of perpetual licenses, transitioning to a subscription model and pulling these products into more expensive bundles.

When T-Mobile attempted to renew its support services for a third year at a cost of $5,288,398.45, Broadcom denied the request. According to T-Mobile’s filing, a representative from Broadcom stated in an email: “Broadcom announced end of available of all perpetual products, which includes Stated Out Year Renewals for perpetual support.”

Judicial Developments

In light of these circumstances, a judge has issued an injunction that allows T-Mobile to receive support services from October 2025 through August 3, 2026. This is contingent upon a payment of $5.28 million, in addition to a $500,000 undertaking. T-Mobile aims not only for this interim support but also seeks a judicial declaration affirming its entitlement to renew support services, along with any other relief the court deems appropriate.

The Importance of VMware in T-Mobile’s Operations

The outcome of this case carries significant implications for T-Mobile, especially in its ongoing migration efforts. Such transitions can be arduous and costly, making the preservation of support services critical. With virtualization playing a vital role in modern IT infrastructure, the stakes are high for both T-Mobile and Broadcom.
